Welcome to Bulker ("Service"), a product of I LIKE BASIC PTY LTD ("Company," "we," "us," or "our"), an Australian company. By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Description of Service

Bulker is an AI-powered research tool that provides access to AI personas for quick product research and feedback. The AI personas are powered by artificial intelligence and are designed to simulate human responses for research purposes.

Important: AI personas may produce inaccurate, incomplete, or biased responses. The Service is intended for preliminary research and quick checks only, not as a replacement for user research with real human participants.

2. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security and confidentiality of your login credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account
  • Use the account for your individual use only; sharing login credentials or account access with others is prohibited
  • If multiple people in your organization need access, each person must create their own account

4. Subscriptions and Payments

The Service offers both free and paid subscription tiers:

  • Free Tier: Limited access with usage restrictions and throttling
  • Paid Subscriptions: Enhanced features, increased usage limits, and priority access

For paid subscriptions:

  • Payments are processed securely through our third-party payment provider
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Refunds are handled in accordance with Australian Consumer Law
  • We reserve the right to modify pricing with at least 14 days' written notice before your next billing cycle. If you do not agree with a pricing change, you may cancel your subscription before it takes effect.
  • Cancellation takes effect at the end of the current billing period; you retain access to paid features until then

Credits:

  • Credits are the unit of usage for creating AI personas, as described in the Service
  • Unused credits roll over between billing cycles for as long as your subscription remains active
  • Credits require an active paid subscription to use; if your subscription lapses or is cancelled, unused credits are retained but cannot be used until a subscription is reactivated
  • Credits are non-transferable and have no cash value
  • Purchased credit packs are subject to the same terms

5. Usage Restrictions and Acceptable Use

You agree NOT to use the Service to:

  • Conduct any illegal activity or violate any applicable laws or regulations
  • Generate, distribute, or facilitate harmful, abusive, harassing, or threatening content
  • Produce content that promotes discrimination, hatred, or violence against individuals or groups
  • Create deceptive content intended to mislead others about its AI-generated nature
  • Engage in activities that could harm minors
  • Infringe upon intellectual property rights of third parties
  • Attempt to reverse engineer, decompile, or extract the underlying AI models
  • Circumvent usage limits, throttling mechanisms, or access controls
  • Use automated systems to access the Service in violation of rate limits
  • Resell, redistribute, or sublicense access to the Service without authorization
  • Generate content for high-stakes decisions in healthcare, legal, financial, or similar domains without appropriate professional oversight

Prohibited Uses: Using the Service for any illegal or unethical purposes is strictly prohibited. We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice or refund.

Fair Use Policy

Features described as "unlimited" (such as saved chats and saved panels) are subject to a fair use policy:

  • The Service is intended for normal, individual human use
  • Usage that is automated, programmatic, or significantly exceeds typical human usage patterns may be considered abuse
  • We reserve the right to throttle, suspend, or restrict accounts exhibiting abusive usage patterns
  • We will make reasonable efforts to notify you before taking action, except in cases of severe or ongoing abuse

6. AI Personas and Limitations

You acknowledge and agree that:

  • AI personas are AI-generated and do not represent real individuals
  • AI responses may contain errors, inaccuracies, biases, or hallucinations
  • You are solely responsible for verifying and validating any insights or data obtained from the Service
  • The Service should not be used as the sole basis for business decisions, product launches, or strategic planning
  • Results from AI persona research should be supplemented with research involving real human participants
  • Panel compositions (the demographic makeup of AI personas assembled for your research) are modeled using AI and, where available, grounded in real-world demographic data from third-party providers
  • Despite best efforts, AI-generated panel compositions may be nonrepresentative, skewed toward particular demographics, or lack diversity — particularly when third-party demographic data sources are unavailable or incomplete
  • No guarantee is made regarding the demographic representativeness, diversity, or statistical accuracy of any panel composition
  • AI personas are approximations of human behavior; AI inherently cannot model the full complexity of a real human being
  • AI models may exhibit natural behavioral skews (such as a tendency toward particular reasoning patterns or dispositions) that do not reflect real human diversity of thought and behavior
  • Best effort is taken to make AI personas behave as close to real people as possible, but no guarantee is made on the accuracy of such modeling
  • For transparency, the Service displays a panel methodology describing how each panel was constructed, including composition and trait distributions of AI personas
  • This methodology is provided for informational purposes only; due to the non-deterministic nature of AI, actual panel behavior may diverge from what the methodology describes
  • Best effort is taken to ensure transparency so that users understand how panels are constructed
  • AI-generated output may inadvertently reproduce, resemble, or be derived from copyrighted material, trademarks, or other intellectual property of third parties; you are solely responsible for ensuring that any output you use, publish, or distribute does not infringe third-party rights

Panel and Persona Disclaimer: While best effort is taken to create representative, diverse panels and to model AI personas that closely approximate real human behavior, due to the inherent limitations of AI, no guarantee is made regarding panel representativeness, persona accuracy, or the fidelity of AI-generated behavior to real-world human responses.

7. Intellectual Property

The Service, including its design, code, features, and AI models, is owned by I LIKE BASIC PTY LTD and protected by intellectual property laws. You retain ownership of content you input into the Service. By using the Service, you grant us a limited license to process your content solely for providing the Service.

Output generated by the Service may be used by you for lawful purposes, subject to these Terms. We do not claim ownership of AI-generated output, but we also make no warranties regarding originality or non-infringement. We make no guarantees that AI-generated output is free from third-party intellectual property claims; you are responsible for your use of any output from the Service.

8. Privacy

Your use of the Service is also governed by our Privacy policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE
  • ACCURACY, RELIABILITY, or COMPLETENESS of any content or results
  • UNINTERRUPTED or ERROR-FREE operation
  • SECURITY or FREEDOM from viruses or harmful components

We do not warrant that the AI-generated persona responses will meet your specific needs, be accurate, or be suitable for any particular use case.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

I LIKE BASIC PTY LTD, its directors, employees, partners, and affiliates shall NOT be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from reliance on AI-generated content or AI persona feedback
  • Damages resulting from decisions made based on Service output
  • Business losses from product decisions informed by AI persona research

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) AUD $100.

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law or other applicable laws.

11. Indemnification

You agree to indemnify, defend, and hold harmless I LIKE BASIC PTY LTD and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to or generate through the Service

12. Modification of Service and Terms

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We may also update these Terms periodically. We will provide at least 14 days' notice of material changes, via email or through the Service. If you do not agree with the changes, you may terminate your account before they take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the modified Terms.

13. Termination

Termination of your account may occur in the following ways:

  • By us, for cause (violation of these Terms, abuse, or illegal activity): we may suspend or terminate your access immediately, without notice or refund
  • By us, without cause: we will provide at least 14 days' notice and issue a pro-rata refund for any unused portion of a prepaid subscription period
  • By you: you may cancel at any time; cancellation takes effect at the end of your current billing period

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account data in accordance with our Privacy Policy
  • Provisions that should survive termination (such as limitation of liability) will remain in effect

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the courts of New South Wales, Australia. You waive any objection to venue in these courts.

15. Service Availability

We do not guarantee that the Service will be available at all times. The Service may be subject to interruptions, delays, or errors. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any loss or damage resulting from Service unavailability.

16. Third-Party Services

The Service relies on third-party providers, including AI model providers and payment processors. We are not liable for failures, interruptions, policy changes, or limitations imposed by third-party providers. Third-party services are governed by their own terms and privacy policies.

17. Electronic Communications

By creating an account, you consent to receive electronic communications from us, including service announcements, account notifications, and billing information. These communications are part of the Service and you may not opt out of them while maintaining an account. Marketing communications are optional and may be unsubscribed from at any time.

18. Assignment

We may assign or transfer these Terms and our rights under them, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, wars, terrorism, riots, government actions, power outages, internet or telecommunications failures, cyberattacks, pandemics, or failures of third-party service providers.

20. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it later. Any waiver must be in writing and signed by us to be effective.

21. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and I LIKE BASIC PTY LTD regarding the Service and supersede all prior agreements and understandings.
